Jokes Now are Not Considered Jokes Later

I once represented a company that operated like a frat house. They allowed name calling, slaps on the buttocks in the hallway and vulgar gestures because everyone went along with it and everyone thought it was funny. The owner of the company claimed to not have knowledge.

Guess what happened?

One of the employees wasn’t meeting his monthly quota and was fired.

The terminated employee claimed discrimination, harassment and retaliation. Others ended up coming forward and making similar claims.

This type of behavior often takes place in restaurants, sporting event companies and the hospitality industry in general.

Even if “everyone knows they are joking” or “it’s not a big deal” it won’t necessarily seem so harmless when presented to a jury.
