Does your business need an HR Consultant or an Employment Lawyer? How do you know which one you need?

HR Consultants can assist with hiring, payroll, benefits and workplace culture. However, there are substantial benefits to hiring a lawyer when making decisions regarding employees:

1. Attorney Client Privilege- Your business secrets are safe with a lawyer. Attorney client privilege protects confidential communications between the business and lawyer. Conversations and e-mails with n HR Consultant who is NOT a lawyer may be required to be turned over to an opposing party.

2. Unlicensed Practice of Law May Be a Felony - HR Consultants who are NOT lawyers cannot provide legal advice, and therefore cannot tell you whether the business is "compliant" with various state and federal laws. Unlicensed practice of law is a felony in Florida and other jurisdictions.

3. Litigation Experience - The best attorney for a business is one who has litigation experience. This is someone who has first hand knowledge and has litigated the policies once they are challenged in court. HR Consultants likely don't know how certain policies are challenged, various legal issues and complications that arise and how judges/juries will view certain policies if litigated.
